AVIARY DESIGN — BIRD PURCHASE AGREEMENT & DEPOSIT POLICY 1. DEPOSIT. A deposit reserves your bird and starts the order: • In-stock bird: 25% of the price as a deposit (minimum $100). • Special order ("any species"): a $200 deposit to begin sourcing. The deposit is applied to your total. 2. DEPOSIT REFUND TERMS. • FULLY REFUNDABLE if Aviary cannot source/deliver the bird, or if the bird fails its pre-delivery health check. • NON-REFUNDABLE if the Buyer cancels AFTER the bird has been reserved or sourced for them. • Refundable within 48 hours of placing the deposit if nothing has been reserved yet. 3. BALANCE. The remaining balance is due before or at delivery. Ownership passes to the Buyer upon full payment + delivery. 4. HEALTH GUARANTEE. The bird is warranted healthy at delivery. Have it examined by an avian veterinarian within 3 business days. If a licensed avian vet documents a pre-existing illness within that window, Aviary will arrange a replacement or refund of the bird's price. 5. DELIVERY. Delivery is fulfilled by Aviary's breeder partner. The Buyer must provide a safe delivery location and be available at the arranged time. Special-order delivery timing is an estimate. 6. CARE & SUITABILITY. The Buyer confirms they can properly house and care for the species and accepts care responsibility at delivery. Birds are living animals; behavior and lifespan are not guaranteed. 7. NO RETURNS. Live animals are non-returnable except under the Health Guarantee (§4). 8. LEGAL COMPLIANCE. The Buyer is responsible for any permits and for the legality of owning the species in their location. 9. PRIVACY. Aviary keeps the Buyer's information confidential and shares only the delivery address with the fulfilling breeder, solely for delivery.
